SAFM Activator Terms and Conditions

The following Terms and Conditions (“the Agreement”) are between Purpose Inc., 137 Concord Rd, Sudbury, MA 01776 (“Provider”, “School of Applied Functional Medicine™”, and/or “SAFM”) and you (the “Member” or “Participant” as identified by the name and address entered upon submission of agreement to these Terms and Conditions), collectively referred to herein as the “Parties”, and covers the relevant tenets of the SAFM Activator membership program, a subscription-based offering designed to provide diverse practitioners the support they need beyond SAFM’s Training Program in order to be a capable, confident, fulfilled practitioner using applied functional medicine in clinical practice.

Participant access to the Activator Program website (“Program Website”) and associated Membership benefits is subject to Participant compliance with these terms and conditions.

PAYMENT TERMS AND CONDITIONS

Activator Membership is only available for purchase by current or prior enrollees of SAFM’s Training Program.

The Participant acknowledges and agrees that: 

  • All payments are to be made in United States Dollars unless otherwise agreed upon in writing by Purpose Inc.
  • The Participant will provide Purpose Inc. with a valid credit card at the time of initial purchase and ensure an active payment method for the term of membership.
  • The Participant commits to a minimum three (3) month term of membership. 
  • Membership access is effective upon the upcoming kick-off date outlined in the check-out process. 
  • Membership is auto-renewed every 30 days unless the Participant elects otherwise per the Membership cancellation policy outlined herein. Billing will occur on the 1st day of the month.
  • Membership fees are authorized by the Member to be automatically debited using the credit/debit card registered with Purpose Inc by the Member at enrollment.
  • Membership enrollment occurs only during open enrollment windows. 
  • Changes cannot be made to a payment schedule once the monthly payment series for any Program, Course, or Membership has begun.
  • Purpose Inc. reserves the right to change membership pricing at any time upon providing reasonable notice. 

REFUNDS/TRANSFERS/CANCELLATION POLICY

Refunds. Purpose Inc. does not  offer any refunds for the Membership once payment has been received.

Transfers. Membership is non-transferable.

Cancellations. Membership may be canceled at any time after the initial 3 month membership commitment by contacting SAFM Support

For cancellation after the membership commitment period:  If cancellation is received by the 15th of any month, Activator Program access will end at 11:59 p.m. ET on the last day of the month in which the cancellation notice was confirmed received by Purpose Inc. If cancellation is received after the 15th of any month, Activator Program access will end at 11:59 p.m. ET on the last day of the following month. The Participant understands that this will also end their SAFM dashboard access, and that to maintain access to their dashboard after cancellation requires enrolling separately in one of the then available membership options.

DELIVERY AND ACCESS

Membership is an online subscription program offering designed to provide support beyond the SAFM’s Training program. Membership conveys Active student status and includes access to then current SAFM Activator Program components. Membership access is through the Activator Hub (an online platform for community engagement) and the SAFM Activator course within the SAFM Dashboard. Participant access is with the SAFM account login credentials already established by the Participant to access the Participant’s Program coursework.

MEMBERSHIP LEVELS

Membership is available at two (2) different purchase levels. Membership levels are determined based on the curriculum status of the Participant in the SAFM Program. 

  • Non-AFMC Certified Level – Activator program membership provides access, at non certified membership pricing, to students in good standing with SAFM who have a passing score on the AFMC Level 2 exam. 
  • AFMC Certified Level – Activator program membership provides access, at certified membership pricing, to students in good standing with SAFM who are AFMC certified and maintain active AFMC certification status. 

REGISTRATION ACKNOWLEDGEMENTS

Upon enrolling in the Activator Membership, the Participant acknowledges and agrees that:

  • As a supplemental subscription, all terms and conditions outlined in the SAFM Applied Functional Medicine Training Program Terms and Conditions at the time of Membership enrollment apply, including Participant adherence to the SAFM Code of Conduct and the SAFM Limited Use of Professional Materials Policy.
  • Any communications regarding updates or changes to Membership will be conducted via the email address associated with the Participant’s SAFM Program account. To avoid any interruptions in service, the Participant is responsible for keeping current the email address provided via the Participant’s SAFM profile, accessible via the Edit Profile option on the Program Website.
  • Participants who benefit most from a paid Membership will have available opportunities to apply specific functional medicine concepts and principles taught throughout the Program in active professional practice regardless of health or wellness environment and/or business model. 
  • Live attendance is not required to access respective materials and recordings. 

PERSONAL RESPONSIBILITY AND RELEASE OF CLAIMS

SAFM retains the right to change the form, nature, and content of the Membership (and all of its components) at any time without prior notice to the Member. Purpose Inc is not responsible for any impact these changes have on the Participant and/or the Participant’s business.

SAFM is committed to personal, professional responsibility. The Member must use any information gleaned from the SAFM involvement in accordance with the rules of the regulatory entity that has awarded the Participant’s license and/or certification. The Participant acknowledges and assumes full responsibility for the use of any and all information gleaned from the Membership via any component for any purpose. It is the Participant’s responsibility to assess, decide, and accept responsibility for what (if any) information taken from this Membership is appropriate for use in supporting any client or patient for any purpose at any time.

The Participant releases Purpose Inc. and its administrators, officers, directors, shareholders, employees, teachers, lecturers, agents, representatives and staff (collectively, the Releasee(s)) from any and all liability, damages, causes of action, allegations, suits, sums of money, claims and demands whatsoever, in law, admiralty or equity, which against the Releasee(s), the Participant ever had, now has or will have in the future against the Releasee(s), arising from the Participant’s past or future participation in or use of information and guidance gleaned from, or otherwise with respect to the Membership.

SEVERABILITY

If any term or provision of this Agreement is determined to be illegal, unenforceable, or invalid in whole or in part for any reason, such illegal, unenforceable, or invalid provisions or part thereof shall be stricken from this Agreement, and such provision shall not affect the legality, enforceability, or validity of the remainder of this Agreement. If any provision or part thereof of this Agreement is stricken in accordance with the provisions of this section, then this stricken provision shall be replaced, to the extent possible, with a legal, enforceable, and valid provision that is as similar in tenor to the stricken provision as is legally possible.

GOVERNING LAW AND JURISDICTION

This Agreement shall be subject to and construed and interpreted in accordance with Laws of the State of North Carolina, United States of America without regard to its conflicts of law principles. 

 All legal proceedings relating to the subject matter of this Agreement shall be maintained in the state or federal courts sitting in North Carolina and each party agrees that jurisdiction and venue for any such legal proceedings shall lie exclusively with such courts.

 In the event of any dispute between the Parties arising in connection with this Agreement or any associated Agreement entered into pursuant to this Agreement, the Parties shall use all reasonable endeavors to first resolve the matter on an amicable basis, within a period of Sixty (60) days. No recourse to arbitration by one Party against the other Party under this Agreement shall take place unless and until such procedure has been followed. Notwithstanding the foregoing, this Clause will not apply to disputes regarding Confidential Information or Intellectual Property. 

 Any unresolved disputes or claims which may arise out of or in connection with the Agreement may be referred to arbitration in accordance with the Federal Arbitration Act. The arbitration proceedings will be presided by a sole arbitrator to be appointed based on mutual consent of both Parties in writing. The award of the arbitrator shall be final and binding on both the Parties.

Under no circumstances may any party interrupt or seek an injunction of SAFM’s business.
